Further to the receipt of a proposed Settlement Term Sheet, by the Kelly Parties and a certain shareholder, on 6 February 2024 the receivers invited unitholders to vote on the proposed settlement term sheet by 19 February 2024.
The majority of unitholders across all Trustee Entities voted in favour of the proposed resolution (no votes against). The majority of shareholders across all Operating Entities also voted in favour of the proposed resolution.
On 21 March 2024, an application was made to court to seek the Courts approval of the Settlement Deed. At the directions hearing on 8 April 2024, based on court availability, a one-day hearing has been scheduled for 22 May 2024 to consider the approval of the Settlement Deed, the receivers' remuneration and other matters.
